Key aspects of labor certification include:

Employer responsibility: The employer seeking to hire a foreign worker must obtain labor certification from the DOL before petitioning for certain employment-based immigrant or nonimmigrant visas, such as the EB-2 and EB-3 immigrant visas or the H-1B nonimmigrant visa. The employer is responsible for initiating and completing the labor certification process.
Job requirements: The employer must first establish the minimum qualifications, skills, and experience required for the job position. These requirements must be based on objective criteria and must not be tailored to the qualifications of a specific individual, including the prospective foreign worker.
Recruitment efforts: As part of the labor certification process, the employer is typically required to conduct recruitment efforts to actively seek qualified U.S. workers for the job position. This may include advertising the job vacancy in various media outlets, posting the job on online job boards, and conducting job fairs or recruitment events.
Prevailing wage determination: Before filing the labor certification application, the employer must obtain a prevailing wage determination from the DOL. The prevailing wage is the average wage paid to similarly employed workers in the same occupation in the geographic area where the job is located. The employer must offer the foreign worker a wage that is at least equal to the prevailing wage.
Labor certification application: The employer submits a labor certification application to the DOL, providing detailed information about the job position, the recruitment efforts conducted to find qualified U.S. workers, and the proposed terms and conditions of employment for the foreign worker. The application is reviewed by the DOL to ensure compliance with labor standards and regulations.
Certification or denial: If the DOL determines that the employer has met all labor certification requirements and there are no qualified U.S. workers available for the job position, it will issue a labor certification, allowing the employer to proceed with the visa petition process for the foreign worker. If the DOL finds deficiencies or violations, the application may be denied, and the employer may have the opportunity to appeal or reapply.
