Business Innovation Stream Subclass 188 Visa

The Business Innovation stream is for successful businesspeople who want to establish or develop a business in Australia.

Eligibility conditions

Applicants for the Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream must meet several eligibility requirements for their visa to be granted. The applicant must have:

  • A nomination from an Australian state or territory government 
  • Ownership in one more business for at least 2 of the previous 4 financial years, which must have had an annual turnover of at least AUD$500,000 in those years
  • Ownership of one of the following: 
    • At least 51% of a business with an annual turnover of less than AUD$400,000 
    • At least 30% of a business with an annual turnover of morethan AUD$400,000 
    • At least 10% ownership of a publicly listed company
  • A total of AUD$800,000 in business and/or personal assets, which must have been acquired legally and must be able to be transferred to Australia within 2 years of the visa start date. Your partner or spouse’s assets count towards this sum.

If the business nominated to meet the conditions above provides services of a professional, technical, or trade nature you must have spent a maximum of 50% of your time providing those services personally, and a minimum of 50% of your time managing the business.

Applicants must normally be 55 or younger to qualify for this visa, but the age requirement can be waived at the discretion of the nominating state or territory if the proposed business will benefit the state or territory’s economy greatly.

Points test

Applicants must score a minimum of 65 points on the Business Innovation and Investment (Provisional) visa (subclass 188) points test.

Investor Stream Subclass 188 Visa

The Investor stream is for investors who want to invest at least AUD$1.5 million in Australia and continue business and/or investment activity in Australia for at least 2 years.

Eligibility conditions

Applicants for the Business Innovation and Investment (Provisional) visa (subclass 188) Investor stream must meet several eligibility requirements for their visa to be granted. The applicant and/or their partner (if applicable) must have:

  • A nomination from an Australian state or territory government 
  • At least 10% ownership and direct management of a qualifying business for at least 1 financial year in the past 5 financial years, OR
    • Eligible investments of at least AUD$1.5 million
  • A high level of management skill relating to the qualifying business or eligible investment, with at least 3 years of direct management experience 
  • A total of AUD$2.25 million in business and/or personal assets, which must have been acquired legally and must be able to be transferred to Australia within 2 years of the visa start date. You and/or your partner must have owned these assets for at least 2 financial years 
  • The intention to live in the nominating Australian state or territory for at least two years

Applicants must normally be 55 or younger to qualify for this visa, but the age requirement can be waived at the discretion of the nominating state or territory if the proposed investment will benefit the state or territory’s economy greatly.

Points test

Applicants must score a minimum of 65 points on the Business Innovation and Investment (Provisional) visa (subclass 188) points test.

Significant Investor Stream Subclass 188 Visa

The Australian Significant Investor stream 188 visa is for investors who want to invest at least AUD$5 million in Australia and continue business and/or investment activity in Australia after the period of their provisional visa.

Eligibility conditions

Applicants for the Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor stream must meet several eligibility requirements for their visa to be granted. The applicant and/or their partner (if applicable) must:

  • Receive a nomination from an Australian state or territory government or from the Australian Trade Commission (Austrade)
  • Have at least AUD$5 million in investment funds, which must have been acquired legally and must be available to invest in Australia 
  • Agree not to bring any legal action against Australia for any losses related to the investment


Applicants must also be willing to reside in Australia for at least 40 days per year for the duration of the visa. Another option is for the applicant’s spouse to live in Australia for 180 days per year for the duration of the visa. Applicants must reside in the state or territory which nominated them (if any).

Investment conditions

Significant Investor stream applicants must be willing to make a ‘Complying Significant Investment’ of at least AUD$5 million over 4 years. The investment must be made as follows:

  • Minimum AUD$500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies 
  • Minimum AUD$1.5 million in approved managed funds investing in emerging companies listed on the Australian Stock Exchange 
  • Minimum $AUD3 million ‘balancing investment’ in managed funds that may invest in a range of assets, such as ASX-listed companies, Australian corporate bonds or notes, annuities, and commercial real estate.

Direct investment in residential property/real estate is prohibited, and indirect investment through the managed funds listed above is severely limited.

Premium Investor stream (Subclass 188)

The Premium Investor stream is for investors who want to invest at least AUD$15 million into an Australian ‘complying premium institution’ and continue business and/or investment activity in Australia after the period of their provisional visa.

Eligibility conditions

Applicants for the Business Innovation and Investment (Provisional) visa (subclass 188) Premium Investor stream must meet several eligibility requirements for their visa to be granted. The applicant and/or their partner (if applicable) must:

  • Receive a nomination from from the Australian Trade Commission (Austrade)
  • Have at least AUD$15 million in investment funds, which must have been acquired legally and must be available to invest in Australia 
  • Agree not to bring any legal action against Australia for any losses related to the investment

 

Investment conditions

Premium Investor stream applicants must be willing to make an investment of at least AUD$15 million. The investment must be made into one of the following:

  • Australian securities exchange listed assets 
  • Australian government or semi-government bonds or notes 
  • Corporate bonds or notes issued by an Australian exchange listed entity (or wholly owned subsidiary of the Australian listed entity) or investment grade rated Australian corporate bonds or notes rated by an AFS licenced debt rating agency 
  • Australian proprietary limited companies 
  • Real property in Australia excluding residential property 
  • Deferred annuities issued by Australian registered life companies 
  • State or territory government approved philanthropic contribution
